I-864 and other filing questions

Hi all,
I am getting ready to file but me and my husband are confused about I-864.

On line 21 a says to enter the number you entered on line 10. That would be 1 for me.

In the section "Persons not sponsored in this affidavit"
b. yourself 1 (my U.S. citizen husband is the sponsor)
c. if you are currently married, enter 1 for your spouse . (well, should he enter 1 for me since he already entered 1 on line 21 a?)
d. if you have denpendent children , enter the number here. I have a daughter from my ex, who is in my custody and we claimed as dependent with my current husband. Then we have a daughter together (me and my current husband), but she was born in March this year. My question is: should we enter 1 or 2. I would say 2 because they are our dependents even if we could not claim the younger on the last year's tax return. Am I correct?

We are ready to file, and this is what concerns us. Also, I made the cover letters, I read the tips for assembly and I am still a bit confused. Can I put all forms in a folder with dividers separating the different case types, or should I only use clips to separate the different cases (we file them all: I130, I485...). I just want to get it right. Also, the dividers are on the side and you would place the labels there.


I just read form I-130 and it says "if you file concurrently with I485, send to ...Chicago, IL 60680-4107", but on form I485 says that if you file concurrently with I130 you should send to ....Chicago, IL 60680-4120

Please answer as soon as possible. We would like to send the form tomorrow.

I_864 - no proof of current employment

Oh my God, we sent the papers and we did not include the "proof of current employment". It was not mentioned in the form so we did not include it. I just read today on the website that it is requiered.

WHAT WILL HAPPEN? WILL THEY STILL START PROCESSING OR WILL THEY SEND US AN RFE BEFORE THEY EVEN TOUCH OUR CASE. we included the most current tax returns...but not that proof...

Please answer. we are really worried...

There is no need to panic. It would have been nice to send proof of employment, but if you didn't send there is nothing to panic about. USCIS may ask you to provide one and send you a RFE, but I highly doubt it. Tax returns and W-2 are most important documents that USCIS looks for. You can take the emplyment verification letter on the day of the interview incase the officer asks for it. I had a job when I applied for my wife's AOS back in January but now I don't have a project. Does that mean this will be a big deal on the day of the interview? I don't think so. Most of my friends who went for the interview were never asked about their current job anyways.
In short, you should be all set and USCIS will still go ahead and process your application. Relax and this wait will be over soon.

We did not send W-2s. We sent IRS transcripts for 2007,2006, and 2005. In the instructions it said that if you send IRS transcripts, you do not have to send W-2 or any other forms.

Should we have sent W-2 anyway? I thought IRS transcript ruled.

Now I am getting worried. This whole process drives us nuts and having a 2 month old crying does not help either.
