I-864 Affidavit of support - NEED ADVICE on work authorization options

My husband has a disability and is on a fixed income. I\'m his dependent and he is not eligible for financially sponsoring me (under $10,000/year - under poverty income guideline). We don\'t have any other investments or assets besides our monthly fixed income. Since, I don\'t have anybody to sponsor me (I also asked some churches and had no luck).

1. Is it possible that I-864 can be WAIVED due to my husband\'s disability and me being his dependent? Otherwise, I feel it would be discrimination, since he has a disability.

2. Since, I apply for adjustment of residence (I-485) and at this time I cannot submit I-864 affidavit of support. Is there a way that I can get at least my work authorization (without I-864), so that I can go work and earn money for us?

Financially, we cannot afford to wait until I find a affidavit of support (maybe in a few months or so) in order to get my work authorization and to be able to work.

Orela did you consult an immigration attorney

Try getting some free legal advice. Some attorneys do pro-bono work. You need to do some research. Contact local churches/charities.

Perhaps one of your husbands relatives could give you the 864 since your husband is disabled.

Other than that your husband can petition his senator to pass a private bill. A little difficult for them to agree to but you never know.

Hi, Thanks for your reply and advice.
We\'ve already asked some churches if they can help with the affidavit of support I-864. So far, we didn\'t have too much luck in finding anybody to possibly be the affidavit of support.
Unfortunately, my husband\'s both parents passed away a few years ago and we don\'t have anybody who can help. Maybe the senate with your suggestion of a private bill is a possibility. We have to try this option.
At this point, it is very frustrating and we don\'t know what to do. I need and want to work, but lately there have been a lot of obstacles in our life. But, we keep on trying and we don\'t give up! New year, new luck:) Any advice would be appreciated. Thanks. Have a good day!

Thank you very much for your encouraging email. We got an attorney and he told us he cannot do anything for us until we have a financial sponsor I-864 in order to send off the completed package I-485. I can\'t get my work authorization otherwise (without having a financial sponsor first). Is that true? Does anybody know if there is any other chance? Please let me know. Thanks. Happy Holidays.
