I-824 question

Hello,

After my Green Card approval I filed I-824 to get my wife here from our home country. I got the notice of action approval and it says related consulate is informed. My wife could not come here currently since she studies there, so my questions is there a time limit of this application, will it be invalid after certain period?

Dear Friend,

I believe there is one year restriction limt to file FTJ process after alien get LPR status.

Because you already already have filed 824 and they had approved, YOu are all fine, the consulate process time may vary by countries.

Usually FTJ is 6 month avg process once consulate get spouse info, and once Immigrant visa is issued your spouse MUST enter in US within Siz month or u would be re starting again the process.

You may contact to her consulate for any special request you have, however keep in mind if u delay her process by intentionaly it would raise the "flag".

The best option she may have 'Keep continue her study" and keep continue FTJ process once she get visa she enter U.S and than leave US after , usully get GC within one month, then she may go to home country and continue her study upto six month. remember if an alien stay outsiide country more than 6 month he/she would need to get a special permit to reenter.
