Can anyone comment? Is child protected under the Child status protection act.?
Husband was approved for I 140 May 2001
As myself and middle son were resident in the UK were advised by Texas to send 2 x I 824's . This was sent in Dec 2001 (BEFORE SONS 21ST) and within one year of I 140 approval. We were told that we could not send
I 485's as not resident in the US
It has always been out intention to follow to join as soon as possible after son finished his degree
The I 824's were denied in Oct 2002 saying that husband needs to re-send once his I 485 was approved.
Husband and youngest son were approved for I 485's April 2004 so have now sent new I 824 for son in Uk
I moved to the US Aug 2003 and submitted I 485 so I am in change of status.
My husband, myself and youngest son are living in the US
This leaves our last son (unmarried) stuck in the UK all on his own. He can only visit on a visa waiver for up to 90 days till this is sorted
Hopefully He is protected, but who knows?
