I am preparing the documents for my H-1B revalidation in US. My first H-1B is expiring January/01/2004, my I-94 will expire the same day. Right now my lawyer is filing my H-1B extension through the premium process. I expect to receive my new I-797 form next month.
But at the time I mail out my application for H-1B revalidation, probibally my I-94 already expired. I heard If the Form I-94 has expired, I should submit a valid Form I-797 Notice of Approval from the USCIS for revalidation
I am not quite sure what exactly is a "I-797 Notice of Approval ",
Is that the same thing as I-797 form? Or it is a seperate piece of paper from I-797 form. If it is a seperate piece of paper from I-797 form, is it suppose to come with my new I-797 form in the same package?
