I-765 with H1B1 Visa?

Hello all,

I submitted my I-140 & I-485 back in February, 2007 to the Texas Service Center. I'm still waiting for approval on both forms. I have a H1B1 Visa that expires October 30, 2007. Do I need to get a work permit for myself (I-765) as my visa is soon to expire and haven't received an answer from USCIS? Or Can I continue working covered under my I-485?

Get EAD, Adv Parole, and renew H1B

I strongly recommend you renew your H1B and also get the advance parole and EAD document. Always use the H1B to re-enter the US. You may never need the Advance Parole or EAD but my lawyer recommended both.

Here's one good reason to have advance parole approval - The situation I had before my GC was approved was this - out of the country on a business trip (Mexico). While I was away I got the CRIS email saying my GC was approved. Technically speaking, the H1B is immediately cancelled at the point your GC is approved. Now I had no physical card - it took about 2 weeks to come, and no I-551 (GC stamp) in passport. I re-entered with advance parole which was the only "clean" way to do it.
