I 765 expired form

Hello everyone,

I have read on other immi forums that some people have had their I 765 rejected due to the expiry date on top left corner being 08/30/2008

There is no new version on the website.

What should one do?

Does anyone have any input. Has anyone applied after the 30th of August and got an approval receipt for the expired I 765?
Would appreciate any help as I am about to fill this form for my wife.
Appreciate your help.
 
I am not sure there is a good answer to this until USCIS wakes up and posts an updated revision of I-765.

Some folks are getting their 765's rejected, while others have no problem, even if they filed around the same time. It seems to be hit or miss, so as far as file or not? It's your decision, but there is a good chance 765 will be rejected for outdated form used.
 
The rejection is not due to the expiration date on the top corner.
If you look at the bottom right hand corner you'll see the revision date: (Rev. 05/27/08), and that's the only form accepted by USCIS right now. All previous forms that had the same expiration date but a previous revision date are boing rejected.

That could very well be, but the 5/27/08 revision has been the only online version since early June (when I first downloaded it). So unless people get their forms from sources other than USCIS (that may not be as updated as uscis), it hardly seems coincidental to me that there are several people here reporting rejections, even though they claim to have filed the 05/27 revision with 08/31/08 expiration I-765.

To my knowledge, this is the only reason why USCIS is rejecting a lot of "old" forms being sent to them. They're really not that old, and since the expiration date is the same, some people who are not downloading the form from the USCIS website directly (more than you think) are being rejected.

The only other option is USCIS making a mistake and randomly rejecting some of the new forms as well. Not much we can do about that though, unfortunately.

That would be my theory, too. They probably don't have much time to check all forms and some fall through the cracks just by glancing at the dates. Nevertheless lets hope they post an updated form soon.
 
It's very possible. I know USCIS hired some contractors to speed up the paperwork check but they're not doing a really good job apparently.
I'm not sure a new form would help, it would probably create even more confusion on the already confused people that have to check on our paperwork.. I'm just hoping that in time there will be less and less "old" form being sent so they won't have to cross-check those numbers that often and therefore reduce the possibility of making errors :rolleyes:

EDIT: Since the expiration date is no longer valid, there should definitely be a new form coming out soon. I revise my previous statement of a new form not helping :)

I am in the process of sending the I-130 for my wife. Indeed, the form is expired and a new one is not available. How about I write a note with huge letters saying "Please do not reject this form on the basis of expiration as it is the most updated one from the USCIS website" and attach it to the form?
 
Write a post it note and stick it on top of the form, that's what I'll do myself if no updated form is released. I have just realized that the "expiration" date in indeed... expired! So my bad, I thought it was still current.
Definitely a new form should come out briefly, but in the meantime I would suggest to write a note and hope for the best...
 
The previous edition of I765 form released on 7/30/07 also had the same expiration date of 8/31/08.
