I-751 technical question

Hello,

I am filing fot the removals next Oct 2007 and I have few question about the paperwork to submit to CIS for the removals:

- Bank statements + bills: how many statements should I submit? , and what dates of the statements: the most recent ones?

- Lease: is a dec 2005 copy of the lease ( we are currently renting) fine? ...
or do we need to request a recent copy from our landlord?

- Filing: do we need to file the paperwork in a /ring binder? or just gather the
paperwork in a folder?

Unfortunately, there are no definite guidelines other than those provided by USCIS. People have been approved with varying amounts of documentation.

I do not think it is necessary to provide every month's bank statement. Since they ask for the documents to cover the time since marriage, provide them with 2 or 3 statements representative of each year, for each account/bill/statement/insurance policy.

Send the most recent copy of the lease. If 2005 is the latest one, with both your names, then so be it. You cannot send something you do not have. If you want to, you can request the landlord for a new copy.

Consider sending some photos, labelling the occasions and dates, people in the photos ---- but don't go overboard either. Many have been approved without sending photos at all.

You can also send affidavits from friends/family.

The purpose is to create a good general picture of you as a couple. Remember, you can still be called for an interview by random selection anyway, even though it is unlikely. So maintain perspective; prepare well, but do not fret about it endlessly.

I would not use a binder. Compile it with a cover letter and mail it in one envelope. Good luck.

Once you have submitted the I-751, you should receive a NOA (notice of action) within few weeks to a month. This receipt will mention that you are work and travel authorised for a year after your conditional card expires.
You can travel using this receipt and the expired card. But before you make any travel plans, keep in mind that there is another Biometrics appointment and if you happen to be in 10% of cases, a possible interview that you will have to attend..

I am planning to send my petition for I 751 on Feb 16th 2007 and planning to travel outside the USA on March 15th 2007.. How long will it take to receive a notice of action? Will I be able to receive it before March 15th 2007?

Hello,

When you call the USCIS call center, they normally say it takes anywhere from couple weeks to over a month for receipt. After a month of waiting and still no NOA, you can call and enquire about it. But, you cannot be certain that they will send it out to you exactly by the end of the month. Also, you cannot bug USCIS before the end of the month for NOA, they insist that you wait at least 30 days after your submission.
Depends on the service center when you will get your NOA. Some are better than others. Can you delay your plan of travelling by few weeks, just to be on the safe side?May be you will be one of those fortunate ones that gets the NOA within 2 weeks.

can someone please tell me how long does it take to send NOA I 797 from the Nebraska Service Center after sending the I 751 petition? Does someone have any experience from Nebraska Service Center?

I have experience with the Nebraska SC, but the M.O for all USCIS offices is that your application is acknowledge within 10 days. As such, it is likelythat your might receive your NOA within 10 days of receipt of application. At most, maybe 15 days. :p

In their response, if they are satisfied with your initial submission, you are going to receive a NOA authorizing you to use your expired GC for travel and work purposes while they are reviewing whatever you send them. :rolleyes: So, in the meantime, I will postpone my trip in the event that USCIS takes longer to send me my NOA. :confused: When dealing with bureaucracies, avoid setting definitive dates on anything that you want to do personally, especially while waiting on them to respond to you on something as that important... :o

NOA could come in a relatively short period od time or could take longer, and your travel plans could be affected as you can't travel without the NOA from USCIS. However, if you do travel and they send you a RFE, do you have someone who can send them whatever they might require? :cool:

Once again, there are no established standards that I am aware of, which professes the exact number of days you are going to receive NOA for FP :confused: I am not even sure if it required for the removal of conditions on your GC. Will double check.... :o I have seen people who received their NOA today, and the next day, a NOA for finger prints is in the mail box. For others, it takes weeks before it arrives. :confused:

I suppose that you are traveling with your spouse on this trip? If not, then you spouse should be able to get in touch with you when you are called for FP, which I doubt. On the practice, based on people on this booard: I have seen people who receive NOA for FP on let us say Dec 12, 2006 for a FP to be done on Jan 2nd or 3rd of 07. Overall, about 4 to 5 weeks to the day you are FP. :o

No one can give you an exact number timeline, which will caution you to avoid relying on..... :( US govt moves at a snail pace, except when it comes to hanging other human beings... :eek:

90 days before second anniversary of the issuance of your card. Feb 16th makes this a likely date for you to file. If you like, you can send it via a pigeon to USCIS, and if your pigeon arrives on the 17th or 18th, you are in good shape.... :D

USCIS need to receive it anywhere within that period, not after is has expired... : :eek: Don't treat this like a rocket science ... :rolleyes: You shouldn't lose sleep on when you can file, of couse, you wouldn't want to file on Janu 16th, as this will cause trouble for you... :p
