Hi,
I received my temporary green card on 02/08/2008. My temporary green card expires on 02/08/2010.

I filed for the removal of temporary status using form I-751 and was received by USCIS on Oct 28 2009

Address I sent this to was correct:

U.S. Citizenship and Immigration Services
Vermont Service Center
75 Lower Welden Street
P.O. Box 200
St. Albans, VT 05479-0001

The check was for
$545 - Department of Homeland Security

My application was returned :( with the following blue page notice of Action

Pursuant to 8CFR Sec. 216.4(a) an I-751 joint petition to remove conditional basis of lawful permanent resident status for alien spouse is to be filed within the 90-day period immediately preceding the second anniversary of the date on which the alien obtained premanent residence.

We are returning your I-751 joint petition and any relating fees as your I-751 joint petition was received prior to the 90-day period immediately preceding the second anniversary of the date on which the alien obtained permanent residence

Does this mean I have applied too early I should apply AFTER November 10 2009

I currently have 97 days left (including today) before my temporary status expires.

Can anyone please help verify

I got a letter around a month before the last 90 days started. Once you send I-751, you will get 1-year extension. Don't panic, just keep everything ready and file when you are in your last 90 days. The process takes a few months but you won't be out of status.

You were too early dude. Just apply on Dec 15th, 2009. You are lucky that they didn't cash your check and deny the petition. USCIS is good at stealing your money...:D

You miscounted by 1 day. It is 98 days if you include the "today" (November 2nd) of when you started this thread.

Don't try to time it to the exact day. File it at 85 days or later so if you or USCIS miscount by 1 or 2 days you'll still be OK.

Thank you all for taking the time to respond. Really appreciated.

Since I have the package ready (the one I sent to them- they send it back - with holes punched in for filing).

Can I send the same package back if there are no notes written on it ?

Or should I make a "new" package again ?
 
For the forms that have your signature and a signature date, fill out new ones with a date that is within the 90-day window.
