I-751, please help

Hi, I have to file the I-751 form (removal of conditional resident
status) in September this year. I am filling together with my husband,
however, he is being deployed to Afganistan for 1 year in November 07.
Can we still file in September or do we have to wait for him to get
back from his deployment? We have a lot of evidence to prove that our
marriage is real, but if they still call us for the interview, he can't
attend because he will be out of the country. Do I have to let the
USCIS know this when we file the I-751 form or just send it in and hope
we don't get called for the interview? And in case we do, then explain
that my husband is deployed?
Please help us.
 
Speak with the lawyers in the army. They has to be someway around this. I doubt you are the first army wife in this situation.

Just file your I-751 in September. You will be sent a Notice of action and Biometrics appt. Keep your biometrics fingerprinting appt. Then you will wait to hear a decision on I-751 (usually it takes anywhere from 3 months to more than year to hear on a decision on the case). There is a good probability you won't get interview, but there is also a chance you may get interview. When you do get interview, if your husband comes back by that time, go with him. Otherwise, go without him, take copies of his deployment paper etc. You don't need to be worried if your marriage is legit and if you provide all the documentation during your filing..
