i-751 complicated ex and current marriage

Hi,



I got married on 2009 to a doctor and genuinely fell in love. Our marriage ended after i found out he was cheating on me. This was not only based on my experience but also finding out he had cheated to a few women he wooed. (This was posted on-line. He was a real player). The process of my papers were handled by his lawyer up to a point of my case being in conditional status. After our separation, I had to work my papers on my own since his lawyer wouldn’t provide me assistance and i can't afford to get one. I tried to process my immigration papers by myself and I was able to get a year extension for my conditional status.

During that period of time, i met a guy and same as the first one, he promised me the moon and the stars until i got pregnant and we got married. I'll admit on having poor choices on men. I am currently a nurse striving hard to support Everything: rent, food,bills and child. He DOESN’T want to get a job and i find myself grinding for this worthless relationship.I pity myself for finding it out the hard way. With a kid and working so hard,I wasn't able to keep track with my immigration status until I was notified that my case was moved to our field office ( I cannot pull out any information from UCSIS website) and therefore scheduled a meeting this Friday ( July 31,2015) at our field office. I am really clueless to what they would ask me or if my current marriage might affect my ongoing case.

My current husband and I are going through a divorce (uncontested).

I am currently working at a hospital knowingly my work authorization has expired last year ( I’m trying to make ends meet ).

The only documents i can provide from my Ex-husband are photos, emails, gifts, letter and proof that he cheated on me.

No joint account since he never let me touch his finances only an Amex card he provided me. ( I don't even have his SSN).

I was sent this notification letter as of last May 2014 and only took action on it this week. (negligence due to pregnancy).







These were all the same documents i sent to USCIS until they provided me that one year extension (exp June 2014).

Would i need more evidence? since this is the only documents i can provide.

Should i mention I am currently working?

will they question my "current relationship"?

will this void my ongoing case? (I-751)

Are my chances to lift this conditional status slim?





Please help me get an idea or a structured action that i myself can at least work on prior to this interview. My financial capacities are limited and a very knowledgeable information will be very very much appreciated.

So it seemed like you filed for Removal of Conditions (with Form I-751) on the basis of divorce. Is that right? Once you filed for that, they sent you a 1-year extension letter. They should call you in for an interview at some point. It seems strange if they haven't asked you to come in for an interview in all this time. Could you have missed it?

Your current marriage is not relevant. What matters is that your original marriage (the one you got your green card on) was genuine at the time that you got your green card. You should have submitted ample evidence of the genuineness of that marriage when you filed I-751. You should bring that evidence (and more if you have it) to the interview. Of course they could ask you about your current relationship, and you would have to answer truthfully, but you don't need to bring it up as it is not relevant.

As long as your I-751 is pending (if it is still pending), you are a conditional permanent resident, so you are authorized to work. You just may not have proof of it.

Yes. this was on the basis of divorce. I came from a conservative family in a province somewhere in Asia. Culture and people I had to adapt and unfortunately He has actually "tricked" a few women in his life too. After the divorce obviously, he closed all communications and gave me a hard time to process/retrieve pertinent documents from him. Admitting all i really have are ample supporting documents of which I am worried about. I will come clean to my assigned officer and hope I make the cut especially with the child i have and the burden i am into right now. My mother instincts tells me to survive. I did find it strange that they have not assigned me an appointment. Due to the lack of time, info and money, i thought that appointments would take like long months for processing. I hope and pray this all comes through..
