I-730 Petition Pending

I had filed I-730 petition for my Son who is in Nepal. My Case is pending and If I see the processing time it will almost take a year. So is it possible for him to come in Tourist Visa to come USA while his case is pending? Will Applying for the tourist visa affect the petition? If he is granted tourist visa then what can he do over here about his petition? Is there any chance of getting Tourist Visa or it would be better just to wait till the petition gets approved?
 
Based on my long experience of waiting for approval of I-730's of my family members who are already in USA, I would recommend let ur son wait there for approval. It will be much faster than if he is here in USA. I feel USCIS has a faster lane for beneficiaries of I-730 who are outside USA.The reason I can guess could be that those still outside needs protection from persecution plus needs to join their family. Just to give u an idea how long it takes approval when beneficiary is already in USA, my son is waiting for almost 3 years now. His I-730 is waiting for assingment to an officer now.

One more thing if he applies for tourist visa when his I-730 is pending he will probably not get visa if he mentions his I-730 petition pending (immigrant intention) second if he does not mention about it he will be misrepresenting and if found at later stage every thing will be horrible.

It seems to me that " waiting for assignment to an officer" also means waiting for a visa number. In other words, it seems that the application is ready for adjudication but there is no visa available.

Maybe, I am wrong.

I don't believe there is a numerical limitation on I-730 beneficiaries therefore there are no visa numbers.

I also don't think of any visa number allocation for I-730. The reason for delay is probably due to low pri given to the beneficiaries already in USA over the beneficiaries out side the country (USA)

I call them every Tuesday and try to get some updates about my son's I-730.

Do you think that this strategy can push them to adjudicate my case?

How often do you call to remain them about your forgotten I-730?
 
No, I don't call them I just e mail them every fortnightly to which they respond within a week or so. The last reply they sent me was that my son's background check is now clear & case is waiting assingment to an officer, further more they have said it is unpredictable when it will be adjudicated but indicated thet it will be relatively soon. Surprisingly, my wife's I-730 has been approved althought I had sent both I-730's same time.

I am looking my e mail more than dozen times a day with the hope to see some good news. It is a pass time for me now. To be on safe side I got my son's H1B approved this year too against Master's allocation.
