i-566 ??? why

i have an a-2 visa
i am married to a u.s. citizen and we are both living in united states.

my visa is out of status and has been out of status for a long time (years)

i was under the impression that regardless of my current status i can still file i-130 and i-485 via my spouse...........or am i wrong?

not sure what to do at this point

Even though you are out of status, you still entered with an A-2 visa, so that makes things different from most other people's situations. You might still have to file I-566 and I-508 to properly remove your diplomatic immunity and become eligible for the I-485. Being out of status after entering with an A visa could also bring other complexities. See a lawyer for advice on your situation.

from what department of state told me, they said i566 is only for people who are in status. if im out of status i cannot file i566, i need to contact uscis. uscis tells me to contact department of state. its a never ending circle, not sure if i should just file i130, 1485, et al
