Hi there,

I just sent an I-130 for my spouse.
After I receive a first I-797 receipt, I will apply for a K-3 visa.
I'm taking this way instead of filing an I-485 because I don't want to wait until I have an I-130 approval.

Today, I was told that my husband could file an I-485 with just a receipt of I-130 (I-797). If so, I don't need to apply for a K-3 and I think I'd better go directly for asking his green card.

I'm just confused with different information.
Would anybody help me on this matter?

Jennie,

I assume you are a US Citizen. If so, you do not need to file a K-3 visa unless your husband is outside the US. If he is in the US all you need to do is file the I-485 (and EAD and AP if you would like).

Yes, I'm a US citizen. My husband is Canadian and technically lives outside the US although he can visit me anytime.

The problem is that he wants to work ASAP. Which way is sooner for him to get a working permit, filing the K-3 or the I-485?
