Can one file I-485 without being an employee of the company.
My friend needs to go for studies on a leave of absense while his company is ready to continue his GC. He is still waiting for his labour to be cleared. He is switching to a F1 visa as this is what is required to be a full time student. Meanwhile if his labour gets cleared in next 1.5 yrs i think he can file for 140 without being an employee. But can he file I-485 for himself and his spouse.
