Hi friends,
Could you please help me to answer my queries related to I-485. I have tried sending the mail to my attorney, but not getting any response for the last 10 days. I understand he is very busy with the other files and my query is also complicated.
I hope I can find some guru’s here, who have the patience to read this mail. I will highly appreciate, even if I get the answer of my 1 or 2 queries below.
SOME BACKGROUND:
1. I was working with company A and processed my I-140 in the month of Feb 2007.
2. Unfortunately Company, A got banned for filing any petition from March 2007 to Fe 2008. Following is the statement used by www.dol.com for company A.
“Company A is debarred/disqualified from obtaining approval of any petitions to employ aliens.”
3. My first H1B was getting expired in July 07 and I transferred my H1B to other sister concern (company B), which is still under process with premium processing.
4. Company A and B are with the same management.
5. My wife got H1B approved this year with different company C, but she did not get I-94 (COS), as her H4 was not valid till 1st Oct.
6. But now as I received my H1B transfer receipt, Ins has sent receipt for the motion to reopen my wife’s case.
QUERIES:
1. What are the chances I can get I-140 approved with company A, as banned started after we submitted the application
2. Does the limitation mentioned in the point 2, debars me to file my I-485. On the optimistic side, I think I-485 is mine and not related to the company.
3. At what stage of I-485, I am suppose to go back to company A.
4. Can my wife and me maintain H1B status, although both of us have approved EAD and AP? In this case we will not use EAD. If I-485 is rejected, we can continue working on H1B.
