I-485 using Approved Labour

Hi,

Can any one tell me what are the risks involved in filing I-140 and 485 using Approved Labour. My state labour got cleared and moved to PHILLY DOL on Aug 2nd week and I am still waiting for the approval.

My company is willing to apply for my 140 and 485 using another approved labour. In case if 140 or 485 gets denied/rejected because of some reason, is there any waiting period to reapply for 140 or 485? Can I use my original labour which is on my name for reapplying?

Any kind of input on my problem is highly appreciated...

Yes you can do Labor substitution.

Just make sure that Labor is similar to your labor. Once your labor is approved, you can also apply using it, but must be through a different company, i think. People have been successful with Labour substitution. Wait for other suggestions as well.

Just a note. You can use approved labor internally i.e. in the same company, but if you change the co., you will need a new labor. So, if co. Aapplies labor for employee 1, and if wants to use it for employee 2, it can be done (as in this case). But if co. B wants to use labor for employee 1 whihc was applied by co. A, it can not be done.

Thanks. Sorry, yes, labor substitution is only possible with the same company.
