I-485 Transferred to Miami Office

Any one had their I-485 transferred to Miami for interview. Any idea how long is the wait before you get the interview notice?
Here are my details

I-485/ I-140 Concurrent TSC
ND: January 8, 2003
RD: January 9, 2003

I-140 approval: September, 2003

First FP: January 8th, 2005

I-485 Transfer to Miami: February 10th, 2005

Since I'm in Miami, I really don't mind that they transfered but I spoke to my attorney's office and I was told that it can take anywhere from 12 to 18 months before I can get an interview date. Any one has had similar experiences? Please share.

Miami Processing Date for I-485 is February 3, 2004. Make infopass and go to local office to inquire about your case. Good luck.

Here is the thing, Miami processing dates are for family based I-485 petitions only, they don't process employment EB based petitions and if one does get transfered it is not a priority for them....I really hope this is not true.
Have you tried any follow ups with Miami DO?

Its not a priority for them to provide a processing date, since EB cases are not thier main concern, but, chances are they will get your interview done before the official processing date.
 
case bouncing or lost?

I had my case transferred to Miami on May 14,2004. Never arrived to Miami office. I visited local office several times and still they say file is in Texas. I wrote to Texas and they say file is in Miami. Called 800 number and got transferred to Imm Officer the only thing they can do is sent a case status request to Miami. In their system it is showing Miami is requesting the file since November 2004. Do not know what else to do. I do not have the slightest idea where my case is? Case status online show fingerprints received 07/14/2004. When will they expire? Any ideas.
 
Do you have an attorney?

I would have the attorney get in touch with the AILA liaison and pursue it that route and also get in touch with a Florida Congressman or Senator and put an inquiry through that. What EB category is your case? If you don't have an attorney then I would suggest that you get one.....

Could anybody confirm that applications for renewal of EAD and AP deriving from employment based I-485 that were originally filed at the Texas center
have to be sent to the Chicago lockbox after the file was transferred to the local office?

Do they have to be in the same envelope?

if your I-485 has been transferred to a local office, then EAD and AP applications must be sent to that office, not to the service center.
 
My I-485 was transferred to Miami on 9/27/2004. No news since
then. I took an infopass appointment in December and found out
that the file arrived sometime around 10/22/2005 in Miami. My
fingerprints were taken in Sept 03. No new fingerprinting
appointment. Is it common to wait that long (six months from
transfer date) for an interview? I would appreciate more examples
about the current situation in Miami.

Hi:
New to the forum. But glad I found it. Have tried to create new thread to have couple of questions anwered with limited success.

Assuming the "Tranfer Cases" are more or less the same... no matter what sub office, I would appreciate if someone could respond to the following question...

Situation:
My wife (original petitioner) received the interview letter [for adjustment of status] but I (dependent) have not. Its already been a 2 weeks since she got hers and her appointment is on 4/25.

Question 1
I am wondering if I can just go with her? Or do I need a seperate appointment letter. I plan to go anyways.. but would be helpful to know for sure so that I can be prepared.

Question 2
Is there a trick to securing an infopass appointment? Can I just show up in the morning to the Sub Office here in Tampa. Been trying without success for tampa office (have tried jacksonville and miami offices too).

Any couple who have received/appeared for interviews etc... please comment if you had seperate letters or just the original petitioner got the appointment letter. And any help with infopass or experience about going without an appointment will be very helpful.

Besides the interview letter asks for whole lotta things (some of which i understand) but there is request for affidavit from 3 people (one of which should be our neighbour), to the fact that we are married. That I felt was bizarre.


Anyways any comments would be very much appreciated.
 
Question 1: Do go with her, family cases are supposed to be interviewed together. Maybe yours got lost in the mail.

Question 2: Do you have any firewall running on your system, try a public computer with full access to the internet. Many of my friends have been able to get appointment through infopass and also try in the late evening hours when their servers are not that busy.

But if your wife already has a date then just go with her. They should interview you both together.

BTW do you have an attorney, I would seriously recommend have a reputable attorney accompany you for the interview. It will be a lot less stressfull.

Remember I myself am not an attorney and not qualified to give you legal advice. I strongly recommend get a good lawyer, it should cost you anywhere from $500 to $1000 but it will be monies well spent.

I have an employment based I-485 RD 7/28/2003 transferred to Miami on
9/27/2004. My 1st FP (Sept 2003) expired. I would like to contact a representative of my district (city of Miami) for help with speeding up the process.

Can anybody advise which one of the following is/has been the most helpful? Any experience with waiting in Miami would be helpful.

Completely useless, I got a reply for an inquiry I put in through this office. The reply was from an aid that cannot even type a proper grammatically correct memo, but what I could understand from the reposne is that Miami District Office is currently processing cases that were transferred from TSC in January 2003. Now since my file was transferred in February, 2005 and counter has been zeroed for me it seems like another 12 to 18 months before I get an interview date which I personally think is a complete bull.
So qwerty2 your case was transferred in Sept 2004, you might get an earlier appointment date than me but you never know. My RD is January 2003 but I guess that does not matter anymore.......
And the torture continues on......I wonder how the hell the 2002 filers are still holding on. Hats off for their patience! Good luck qwert2 and keep us posted.

Thank you w8n4ever. All I can add is that from my attorney and from other posts here it appears that 1) the current date for employment based petitions transferred does not coincide with either the Texas center current processing time or the family-based applications current processing time at Miami - this is true in general for transfers to local offices 2) there is no way to inquire about your status other than infopass appointment (however they did not want to give me any info whatsoever beyond confirming that the application has arrived in Miami), or extraordinary measures like writing to your representative in the senate/congress.

The only logical alternative is that they use the receipt date at the local office. But logical is not necessarily the way it works. It could be a sort of two-tier process, in which they try to solve some old cases and in parallel go through what may appear as easy new cases, to control the total amount of backlog. Also, they may not feel compelled to solve a case until the deadline at the original center (Texas) passes; but that again would be an attempt at being fair, logical or consistent.

In relation to your case, since you are transferred in Feb05, you must have contacted D-Balart after that. Please let me know if that's the case. Otherwise, they may have answered you about the service center in Texas,
which is wrong once again, but would make slightly more sense. So your reply must be quite current, if after February, meaningless and useless as it is.

The few examples that seem available here in the forum seem to gravitate around 4-9 months, and one year looks like extreme but of course possible -this refers to other centers as well. Originally, when I've been transferred, my attny said that he guesses it will be over by May.

Is there a way to revigorate this thread and get some more examples of timelines at Miami? I hope others would help. Good luck to all!
 
The last venue (contacting representatives) is quite unclear to
me, that's why I started asking on the forum. Somehow the six
months time interval (from TD or perhaps receipt date at local
office, not to confuse with the original RD) appeared in various
threads. It would be interesting to know if six months is written
any where in the documents/web page of the centers, or has any
official endorsement. In that case we could try to use it in the
inquiry (thinking of some memo from the USCIS).

Then how about the senators from Florida? Did anybody contact their offices?

my case transfered to miami on sept 2003. no luck after that. in mid 2004 I moved to CA and provided my change of address to Miami office, TX srv center and London,KY with AR11 form. I req miami senator to help me on my case after several voice mails and req letters they responded 4 weeks back that they can't help me as I moved to CA and they sent my req to CA senetor. By calling 1800 I was able to req an enquiry on my case. I got the reply after a month( today) sayig that my case is in TX svc center. I went to the local INS office in the mean time to see where my case is. They said they are seeing the case in both the places ( Miami and TX)

Still I don't know how long it will take for them. My attorney firm delayed applying my 765 renewal. Finally they sent to Miami office on 1st of APR. So I don't have 3 months in hand to go for iEAD. Now my question is what to do if I don't get ead before it expires. Now planning to send my papers to CA senetor.

I was able to req the inq based on the my 485 receipt date May 2002 ( no kidding) as both TX nad Miami crossed this date + 60 days and transfered date + 60 days.

Did you mean what if you don't get EAD even *after* the current one expires? I'm afraid you won't be able to work without EAD. You might try to visit your local INS and beg them to give you an interim card once it gets really close to the expiration date. Hopefully, though, you will get EAD before then -- I hear many people have their EAD approved very quickly these days (the fastest I saw in this forum was like a week!), esp. those who filed paper-based application. Even at TSC, processing of i-765 is apparently getting very efficient.

I see.. I read in the forum that when with expired EAD, some people worked without pay and got paid back once the new EAD arrived. I suppose that is illegal, but it seems like it is used sometimes as a last resort.

Personally, when I didn't have work authorization (in my case it was delayed H visa transfer), I didn't work for two months, period. My employer is in the public sector where backpay is strictly prohibited, whether you are immigrant or citizen..
