I just received RFE letter requesting me to send Current Employment Letter. I still with the same firm, however, lately, due to industry downturn, there's been a lag in the recent paychecks. Technically I'm still employed with the firm at the same payscale, however, the paychecks won't be awarded until we get new business. My concerns,

1. How importat are the paystubs in case I get called in for an interview?
2. The company has no problem issuing employment letter, can it cause any problems?

Thanks,

U

You are OK

urauf,

1. How importat are the paystubs in case I get called in for an interview?

--- Pay stubs are just a proof saying that the company is paying.

They wont look in the pay stubs for how much your company is paying and ....

2. The company has no problem issuing employment letter, can it cause any problems?

--- Nope.... You are Absolutely safe. Sumbit your RFE and you should see your approval in mail soon.

BTW Please post your Service Center/140 AD/485 RD/ND/FP/dates.

Will be helpfull to others.

If the CIS only asked for an employment letter, then just send the letter as soon as possible.

If however they call you for an interview and want you to bring the last 2-3 months of paychecks, you need to be careful. If you can't show the paychecks, the CIS may question at the company's ability to pay you on a regular basis (for example bi-weekly).

Totally agree with GC012002. For now, just send an employment letter. If conditions do not improve at ur company, start looking for other employment opportunities and use AC-21. Delay (inability) to pay is serious issue in eyes of USCIS and can cost u ur GC if discovered during interview/RFE.

goodluck!
