I-485 Rfe :(

Folks,

I need your help, pls. oblige

I got an RFE on my I-485 application (SRC 01-250-xxxxx) for:

1. Employment letter (I used AC21 to change jobs and notified the TSC)
2. Documentation to prove that I maintained lawful immigration status from June 1996 to May 1997.

I was a student (I-20) from Fall 94 to May 1996. I have a copy of my PT that is valid from July 15, 96 to July 15, 97. My passport was stamped with my F-1 visa from 8/94 to 08/97

How can I prove that I was in valid status from June 96 to July 15, 97. I know I always maintained valid status all along. I was studying and living in NY when I applied. I do have a copy of the PT card that shows the dates it was valid for

Pls. help...

If you can't find your PT papers, ask your lawyer about filing 485 supplement and $1000 penalty fee to clean your status questions under section 245.
 
Not a Problem - F1 Status is for the duration

Alan2 - F1 status is given for the duration [8CFR§214.2(f)]. It basically means, as long as you maintain your status as a full time student (fulltime defined in the regulation), you have valid status. PT is an extension of the fulltime student status. So, regardless of what your visa stamp says, your I20 and PT card will define your status. From your posting it appears that you are covered for the dates in question.

One more question -

My I-20 says that I had to report to school before 9/94 (which I did) and complete studies not later than 05/97 and that the normal length of study is 3 years

(it was Masters and as a full-time student, I completed in two years, that is, by May 15, 1996)

Do I still need to gather any more documents to prove I was in valid status if I have my I-20, my three year F-1 stamp in my passport and my PT (which started 07/15/96 and not 05/15/96) ? :confused:

Please help...
 
I dont have the PT card issued to me

Hi guys:

I lost my PT card which was valid from 6/1994 till 5/1995.

Is this going to be a big issue.

Of couse I do have a xerox copy of the card with me.

Your input will be appreciated

I think you are overly worried... The dates on I-20 (as I recall) are suggested dates, one can take less or more time depending on their course loads and circumstances.

If you have some trail of paper work that shows you have a valid status (that you said you do) why does it seem that you want to produce stuff more than it is asked for?

I recommend just give the stuff that's asked for, nothing less or nothing more.

Please check with your School's international office about this. I think as long as you apply for OPT before May 15, 1996 and have a receipt or any proof for the same then it should be OK.

Your best course of action is to talk to a good immigration attorney. Worst case enquire about $1000/- fine.

Ok..looking at ur dates..u probably r out of status from may 96 until ur PT started..right?..Having an F-1 stamp doesnt mean anything..all u have to do is register as a full-time student..so i believe there should be an overlap between when u graduate and when ur PT starts..correct me if I am wrong..

I donno if I have helped you here..but 1k should help you out of it..

Responding to another post...losing PT card isnt' a big deal..a copy should be fine...ironically when i went for PP stamping after approval, the lady took my PT card too..I asked her what if I didnt bring it..she said..no big deal..all they need is valid ones..and others if u have them...that's all..
