I-485 RFE from Officer 255

Hello All,

I got an RFE 2 weeks ago and I was looking at all the wrong bulletin boards. I should have come here straight away because this community is active. Here is my case details:

Service Center: TSC
R/D: Aug 2001

Labor filed with position: Software Engineer Team Lead @ Salary X
Adjustment of status filed on August 2001.

Changed job in June 2003. Did not inform INS.
New Position: Database Programmer @ Salary 2000$ less than in labor

April 05, 2004: RFE received from TSC (officer 255) asking details about :
current employer, position, salary and date of hire

The job description is essentially the same but with application replaced by database in all places.

Has any one heard of rejections in such a case ?


Is there a recourse if the 485 is rejected for some reason (in my case it is the interpretation of AC21) ? Like appealing in an immigration court or the like? Or is this an open and shut case?

RFE is NOT about the job description but position, salary, date of hire. So send the same.

Do not volunteer information. Just give only waht is asked. It only confuses more if yo try to give something which is not asked.


If you get RFE for job description then it MUST be same or similar to the on efiled in labor. Please note the word similar and only USCIS knows how to interpret it. Just make sure, it is not drastically different from the labor. Salary should not be an issue but hey I am not an expert.

If 485 is denied then you can appeal but you should have proof or basis for appeal. In your case right now, I d not see any issue other than salary as it is less. If it is more then I read in this forum that it is not an issue. I personally feel that it should not be an issue if it is less. Having job is important because the GC is for job. Slary could vary. Again this is my opinion.
