I-485 returned due to insuficient fees

My husband and I filed our application before the fees were increased, yet we got all the paperwork back due to insufficient fees. We have proof that the application was delivered before the date of the fee increase. Please, advise on what action to take.

We do have a notice from post office that it was delivered on July 27th and we filed I-485, I-130 and I-745. On the receipt it states that the received it on August 6th.
There is something else that bothers me, we live in PA and suppose to file to Vermont office. New receipt states that we should send the forms to Chicago.

You were supposed to file at the Chicago Lockbox not the Vermont SC.

Since you sent it the Vermont, I assume they tried to forward the applications to the correct location on your behalf. Vermont probably received it on July 27, however the National Benefits Center which actually processes the applications received it on August 4.

You may have to pay the new filing fee but it does not hurt to call an see if you can get them to change their minds.

I would think though that you would want the applications processed as soon as possible and go ahead and pay the new fee.
 
The filing charts on the USCIS website show where each particular document should be mailed. This info is also in the instructions for the I-485 form. You should have sent yours directly to the Chicago Lockbox address. As far as the fees, the family-based fees increased after 7/30/07 but the employment-based category didn't increase until 8/17/07.

The direct filing for Adjustment of Status has been in effect since December 2004, it's clearly stated on the first page of form I-485
 
You must rely on USCIS websites for accurate information ONLY.

You are out of luck, you sent it to the wrong address and it never got to where I should have on time, now ponny up the new fees.
