I-485 Rejected, Please Help

I am married with a USC. 3 years My husband filed I-30 and the AOS pactage for me. I-485 got denied without a notice or interview. I re-filed I-485. We didn't re-file I-30. We only included a copy of 797 NOA for I-30. and mailed themm all together to Chicagi Lockbox. Today I received a rejection notice for the following reason:
Evidence is required that an immigration visa petition has beed filed/approved on your behalf.
The following documents may be provided:
Your origanal I-130, if you are filing concurrently; or
Your origanal for I-360, if you are filing concurrently; or
A copy of your Form I-797, if the petition has already been filed/approved.

Please help me, I already sent a copy of I-797 along with my application. Shoud I have my husband re-file I-130 or shoud we mail the original I-130 that my husband filled out and signed 3 years ago. I appriciate any input. Thank you very much in advance.

If you don't have an approval notice of your old I-130, I would definitely ask your husband to file a new I-130.
 
Ok Did you get a rejection notice or intent to reject pending I485, there is a difference between them.

Since you already have an approved I-130 , just fill out a new I485 and attach you I 130 the aff of support, medical etc, also if you can afford an attorney get one else go to legal aid and ask them to look at your documents you are submitting they only cost $ 50.00

Did they cash your check? If you did, that might be a good point to start, at least you would have proof that your husband submitted the I-130 and that they received it. Did you ever received a notice saying that your I-130 was denied? If you didn't, my guess is that it was 'missplaced'. Why don't you try scheduling an infoPASS. Do that ASAP since some times it takes up to a month to get a slot and if not you can try to stop my your DO and see if they're nice and they let you speak with an immigration officer.

bps01, that's not true. I appriciate any input. Ariu4 and a_usc were the first names I could recall at the time. I appriciate your time and anyone who tries to help or share.

No they didnt cash the checks, they sent everything back. I think I am just ganna have my husband refile I-130 on my behalf then try again. Thanks

The I-797 you have, is that the approval notice or the receipt notice?
 
maybe the I-130 your husband filed was incomplete or rejected , if that happened then your I-1485 would be rejected as well.

I would suggest making an INFo pass Appt. bring the NOA for you I-130 and everything you filed originally.
I would resubmit your I-130 filed by USC relative include the NOA you received previously, If they did not cash the first check then definatly send payment with resubmission
 
is yr i-130 ever been approved?

from my understanding, u can file i-130 and i-485 at the same time
u never mention that yr i-130 was approved or not, mostly likely yr i-130 was not approved and they denied yr i-485

and the 797 u sent is just a recepit and was 3 years ago, I think as a USC spouse, their i-130 should be approved within half year

If they sent everything back, I also think that your I-130 was denied and that is why they denied your application too. I would def get an infopass...might be helpful, might not. And file EVERYTHING again. I would attach a letter where you explain that you applied before and you got everything back, etc, etc. Also include your A# if you have one.
