I-485 refiled and unable to check case status

Hello,

My I-140/I-485 package was returned from NSC (shortly after filing) on the grounds that one I-485 page had my faxed signature (I sent that page via fax to my attorney). Subsequently, the attorney refiled the case and I got receipts. The problem is however, the USCIS online case status system doesn't recognize my I-485 case number (both numbers are the same on the notice and on the back of encashed check). All other numbers (I-140, EAD, AP and everything for my wife's including her I-485) are recognized by the online system. The attorney called USCIS and was assured that my case exists and will be processed. It is puzzling to me since I cannot locate the case online. Did you experience similar problems or should I worry? My impression is that the new case number had been assigned after the second filing and receipt notice has the old case number. The fact that my case cannot be traced in the online system really worries me.

Thanks,
Lukasz

the online status is useless anyway.

my online message hasn't changed for two years and yet they asked me to change password at least 5 times.

javaguy1974,

You are not alone. I had a similar problem. I submitted my I-485 last July and the application was returned due to signature probelm. I resubmitted and the case used the same # as the rejected (returned file has a #, too).

My case # is not available in the online database. I called, wrote and e-mailed to NSC and they said "they would figure out the problem..." I have never had my FP appointment because the system could not enter my case #. They did send me a response letter after 6 months saying that my case is still active. "We will schedule your FP appointment soon......" But so far nothing has happened. Anyway I am from Retro country. so I am not worried very much about it. My feeling is that once your case is returned and later on the same # was picked up again, your case # will not be available in the online search database. CIS killed those #s off the database and would never re-activate them.

alshine,

Thanks for your comments. It really doesn't look good at all. I'm not from a retrogressed country and don't want any complications down the road. But if the case cannot be traced how come someone from USCIS confirmed that it exists when my lawyer called them? According to the lawyer, the officer was able to lookup the case in their computer system.

What I got from them was: once it is in their system (if they could find your case in their computer), you are fine. It doesn't matter whether poople outside their network like all our GC guys could see it or not. Hope it helps.
