Hi All,

I have recently heard that EB-1 and EB-2/NIW cases are being given waivers from I-485 interviews with outright approvals.

Does anybody know:

1. What is the percentage of I-485 cases based on approved EB-2/NIW petitions that receive call for interview?

2. What is the percentage of I-485 cases absed on approved EB-2/NIW petitions that receive RFEs?

3. What are the top causes for rejection of I-485 for NIW petitions?

Interviews have never been a requirement for EB-1 or NIW cases, so this waiver does not exist. There was a rash of reports of requests for interviews but it has been a while since then. I think interviews are requested primarily if the petitioner is suspected of having been out of status at any time. This would automatically make them ineligible for AOS and would have to leave the country and do CP (assuming they were not subject to a 3 or 10 year ban). Another reason is that something in their medical or personal history requires some explaining.
