my I-140 is pending. can be approved/denied within 1 month.
now my company is relocating me to india. they are saying they will continue my GC processing? i am gonna file my I-485 by january end.
have couple of questions reg this-
1. since i am getting indian salary(ie 1/4th my current pay in $)
does this have any affect on my GC procesing. what if INS sends an RFE asking for my pay stubs? (before going to India i am gonna send them a pay stub with my current US salary, ofcourse)
2. what happens if i get laid off/ company gets acquired/ company closes down BEFORE 180 days of 485 pending?can i come back to US on my H1 if any of the above things happen? IF i come back can i continue my GC process with a new company?
3. i am unmarried. my lawyer is saying that if i get married BEFORE 485 approval then its fine. she's saying it might be a problem if i apply for my wife's H4 visa since they might ask me for pay stubs? i can apply for my wife's 485 AFTER i get my GC (either thru CP or AOS) and my wife can get her GC with couple of months? is it true?
4. Finally if i decide to go to india what are the things i need to get done in US b4 leaving to india.
i am thinking-
a) I-140 approval notice
b)I-485 receipt notice
c) AP and EAD (which may not be possible, since they take 3/4 months)
am i missing anything improtant?
any advice on these issues will be GREATLY appreciated
