If PD is current...... does your native country factor into the processing time for employment based I-485? ie is it faster for some countries with low number of immigrants as opposed to others?

what makes you say that? The processing time has nothing to do with race, ethnic background and which country you come from. However the cut-off date in Visa Bulletin does have the factors of which country you were born.

If PD is current and not being processed for individual, first thing come to my mind is that person got stuck in name check.

thanks 4 ur responses!

easy buzzhead........ i think u r being a little sensitive n reading too much into my question here. I was in no way suggesting race!! All i simply asked was whether country mattered based on like a quota system for various countries!

If country was not a factor, then what's the point of cross-chargeability? ie using your spouses country of birth instead of yours?

BUT some people have responded that ALL OTHER (not india/china/mex) are the same, so i guess it only helps people that belong to india/china/mex and have a spouse in an OTHER country only?!

I think you are missing the point of the original poster.. He is asking if when PD is current, whether COB still matters? Shouldn't I guess.. But we don't really know how USCIS really works..

As for your Q... yes COB matters if you are using CC.. By using CC, the applicant is using the quota of the spouse's COB.

This is in fact about the same effect as when someone from a retro country:
~ gets GC based on USC spouse
~ invests in a US business to get GC..

He is not subjected to the quota of his COB..

no, I am cool.

I didn't say you were suggesting race. I am just trying to tell you the processing time has nothing to do with the person who is coming from any parts of the world. Don't confuse with Race and Racial profiling and racist and racial discrimation. Race is just the general term for describing where you are coming from originally. If you ever read something from the government form and document, it will ask you what group of race and ethnic backgroup you belong to.

Name check

Dear buzzhd,

I filed 485 11 months ago (08/15/2005; worldwide; EB-2 NIW; NSC). According to USCIS update posted on July 11, they are processing applications received on 08/30/2005. I guess my case is close to review, but I don't want to sit and wait for the best. Instead I would like to find out what is going on with my case, namely the infamous name check.

So I have a question for you: In your signature, you said "NC Initiated in 03/04, Cleared in May 11, 04". Could you tell me how you did NC inquiry? I remember you or eb1doc answered my question some time ago, but I could not find the answers on this forum site.

Thank you so much for sticking around this forum to help me and others! I look forward to hearing from you!
