I 485 processing date based on PD??

I applied concurrent for my I140 and I485 in Aug. 2004.
substitute labor (PD 6/2001).
EB2
I140 approved 4/05.

I 485 - waiting

How does NSC cover the cases of sub labor? If they go by the PD, they should be working on my case anytime now. Is that correct?? I see they are already in mid 2002 for PD processing dates.

I was planning to shift jobs (the place where I am now on contract have offered me full time position). However, the salary is significantly higher. (about 25 %). It is a similar job function, but a Senior position. How much effect will this have on the AC21? Is it ok to invoke AC21 when the 485 is being worked on?


How long does it take for AC21 to get approved???

Plus AC-21 portability clearly states that the job has to be same/similar.
A senior position may or may not be covered under that ...
I think you need to talk to a immigration attorney - keep copies of your old & new job desc and also of the approved labor.

And since EB2 is current, NSC would most likely process it based on your ND (Aug 2004).
 
How are EB3 cases processed? PD or ND/RD?

From some of the postings here and elsewhere, I've seen quite a few EB3 cases processed based on PD.
These are cases with ND on or after March 2004 -- which is way off compared to NSC's official processing date. (7/2003 ?)

So I would guess PD has an impact -- but maybe those cases were lucky ?!?

It really helps. I was under the wrong impression that all the applications are processed based on PD. Thanks for clearing that.
