I-485 Priority Date(Is it I-485 receipt date?)

Hi

I have question regarding PD. My security name check was done last year 11/2005.
I called DOS for status on visa number. They told me that my PD will be I-485 receipt date.

Here are details about my case

I-140/I-485 concurrent filing

LC (substitute) priority date 8/1/1997
I-140 - done 05/2005
FP – 03/31/2005
I-485 receipt date 5/3/2004

What will be my PD? 8/1/1997 or 5/3/2004 ?

Even you are using substitute labor, your priority date is the labor application date.

Here's what I was told

LC date determines if visa number is available or if you are stuck in retrogression.

I485 RD is generally what determines the processing order for I485, assuming a visa number is available.....

You will find your PD on your I-140 receipt/approved letter.

It was substitute. Provided by my employer at 11th hour, just 1 month before my H1-B max limit was about to over. 3-4 month back I got letter from USCIS that security/name check is stuck , But Yester day I got chance to talk to Immigration Officer and She told me that name check was done in 11/2005.

That's why put this question on the forum. I am not sure why I-485 is still pending. Tired of extending EAD and AP. 3rd extension is already filed.

I could not found PD on I-485 receipt, that box is empty. I sent mail to my law firms for PD on my case.
