My I-140 has been approved and I am going to file 485.I didn't do the concurrent filing. So if I file my 485 now, what would be priority date? that means my I-140 filing date will be treated as the priority for 485?
Praveen,
Normally your Priority date is the date that your application for Labor is received by your local labor office. You can also see this in your I-140 receipt.
But once you file I-485, INS also generates a priority date, located in your I-485 receipt, which is the date that your I-485 application is received by INS(BCIS).
But to my knowledge, your actual priority date is the Labor filing date, even if you file individually or concurrently.
Thanks for the reply.Mine is a pre approved labor. My I-140 got approved on that labor. So still my priority would be that labor priority or it carried my I-140 date?
Priority date don't mean a thing these days as all categories are current. In your case, what matters is your I-485 receipt date. I-485s are processed in the order of the date it was received. The sooner you file the better.
