Here are the details :
Priority Date : July 2002
Feb 2003 : I-140/I-485 concurrently filed (EB-2 VSC)
May 2003 : FP1 done; EAD, AP received (me and wife)
May 2004 : EAD, AP 1st renewals received
Aug 2004 : I-140 RFE (Ability to pay)
Sep 2004 : FP2 done; I-140 RFE replied
Nov 2004 : I-140 denied; both I-485s denied
Dec 2004 : I-290B appeal filed
Jan 2005 : I-140 approved; both I-485s re-opened
I have the following questions:
1. Based on some folks who went thru similar situations, I thought our I-485s would get approved within a week or 2 of I-140 approval. However, when I called VSC, the person said that our second FP done during the time between I-140 RFE and I-140 denial may be invalidated due to the I-140 denial about the same time. Is it true ? Also FYI the I-485 status messages never changed after the second FP were done.
2. Also what possible checks are done at the I-485 stage. I know there is Name Check. Is there any way we can know the status of that ?
3. What are the different possible RFEs we can receive at I-485 stage. FYI, I am still with the same employer since filing of the GC.
4. What documents we need to have if we receive an RFE or at the time of GC interview or stamping
5. Under what circumstances is the case transferred to the local INS office
