I 485 pending please help

I got married in November 1999 and
I had an interview in September 2000
there were some documents missing so I had to send them in certified mail
but did not get anything from INS since my interview
my passport have not been stamped
and I do not think that my application have been approved or rejected
when I called the customer service they sad that my application is in process

my questions:

now it is 2 and a half years I\'m married
and 7 months after the interview
and I did not receive anything from INS
I have my work authorization but nothing else

1 will I receive a conditional Permanent resident status
or the non conditional one

2 how long can it take to get it
as I sad my interview was in Sep 2000 and I sent in all missing papers
a week after the interview
I filed in NY

3 Can I file under 245i so I will have 2 applications in process
in case one goes down
my employer already signed the ETA 750a
and posted adds on the internet

Hogo,

From my understanding, if you have been married over two years, you should receive the unconditional green card. I am in somewhat similar situation except I have had no response to my I-485 application yet (except they did cash my check for payment so I know they received it). I talked to an attorney recently and he said to make sure you receive the unconditional one as they might try to give you a conditional one which will make the process longer and slower. I am not 100% sure but this was information given to me by an attorney who seems to know his stuff.

I married a citizen in Aug.99, filed all documents in Oct.99. I haven\'t got interview. He non-stop abused me, I know I can file I-360, but I have already waited for almost two years. He threathened me to withdraw his sponosorship from my case. My question is
1) Do he has rights to withdraw sponosorship without any reason?
2) He wanted to kick me out, I\'m afraid of leaving him, because if I leave him, he will file divorce,then I can\'t file I-360 after divorce.Who can tell me how long it will take for me to get visa number?
3)How can I do now?

I think that you need a good attorney, fast. Beware, there are a lot of bad ones out there. If you want to email me privately, I could say more about attorneys, good and bad.

From my limited experience, if your marriage isn\'t in good standing when you go to your I-485 interview, you will probably have problems. This would be the case, I fear, with you, as your husband also has to attend the interview and support your claim that the marriage is valid.

If you can get over this, then you would have a conditional GC valid for 2 years. If your marriage is not in good standing at that time, then the GC will generally not be renewed. One exception which can be allowed is if there was a divorce as a result of abuse.
