I have this situation which is generally positive. Both my EB1-EA and NIW were approved. I have already filed an I-485 based on my EB1-EA approval and did the finger printing. It's been four months now and no LUD. I didn't take any action yet based on my NIW- I140. Here are my questions:
1-Can I transfer my NIW to consular processing while my other application for the GC is still pending based on my other approval, the EB1-Ea?
2-This way I will have to applications for the Green Card, one here based on I-484 approval and one in my country based on NIW. would that work? Will there be a conflict?
I am doing that because I want to get the Green thing asap. So by double-tracking I will be getting whichever comes first. I have been hearing horror stories about the delay in name check.
