Hi !
My wife is under COS from H-4 to F-1 and since my I-140 is approved, i can file her I-485 also.
Does any one here knows, if she can work on F-1 (teaching assistant) during the time her EAD from I-485 is pending ?
i heard that when you apply for I-485, your F-1 stands cancelled?

on a related note, is there a way one could obtain an interim EAD before 90 days from any office in California? as this will solve the above issue.

please help with your expert comments.

Our situation

My spouse was on F1 and got EAD for OPT and started to work, after 4 months she applied I-485 and EAD which we got after 6 months in mean time she was working on OPT EAD and now using I-485 EAD.

This is what we did, I do not know if F1 is cancelled or not.

I don't think there is a way to get iEAD before 90 days.

thanks RM_CSC for sharing your case.
your condition seems to be similar in that your wife continue to work on the EAD (not from I-485) till she got one from I-485.

Anybody else ever tried to get temporary EAD before 90 days ?

thanks guys for your help.

Can't be on F1 after applying for 485

Once someone in F1 status applies for 485 they lose the F1 status but will be in legal immgration status pending adjudication of the 485 application. Since the person is not on F1 status but on AOS the person cannot work without an EAD.

Reference:

Chat User : I applied for I-485 and the case is being processed. My wife is on F-1. If the case is denied, can wife keep F-1 status?

Attorney Murthy : Once a person on F-1 applies for the AOS, the person loses the F-1 status by law. The only statuses that are allowed concurrently with the AOS are the H1B, H-4, L-1 and L-2.
