I-485 NOID, RFE for Spouse

Hello All,

Need some help here. I had LUD on my I485 on 12/03/07. I called the center and the rep said that they have sent NOID!, I still have not received any letter. When my spouse called, they said they have sent an RFE!. I have two questions....

1. If I dont receive any letter in mail, is there any way to request it by some other way, like fax or something?
2. We have planned trip to india in 10 days. Is it legal to travel when you have NOID? If it is then is it safe?

my details are as below..

Labor file date Oct 2001
485 file date Oct 2006
Used AC21
 
Time for NOID is 30 days from date of issuance. Well, If your attorney firm(mostly them) or you receive the NOID letter , they might need any documentation.

Travelling might be a risky, I would re-schedule my trip in this situation and wait for the NOID reason and provide appropriate documents to Attorney to reply for NOID.

Check with you attorney whether they had received any. Also did you see any LUD on your 140, or 485 lately ?

thansk for replying. there was LUD on 485 on both of our apps, thats when we called.

I had an LUD on the OCT 4th and called USCIS on Oct 19th and that's when I found out I had a NOID - I immediately called my lawyer who had sent the letters to me on Oct 15th, I had until Nov 3rd to submit evidence.

You should keep calling lawyer & USCIS about this, and, or take InfoPass. A lot of people had NOID/RFE around the same time.
 
do not leave the country or travel without first replying to your NOID. NOID/RFE usually is mailed to your lawyer. So get it from them fast and then send them back all docs needed to reply both NOID/RFE and make sure lawyer sends it within 30 days. after this point, call USCIS again to make sure they received ur NOOID/RFE, make sure that your lawyer sends it to correct address and also make sure they dont put it in a package which requires USCIS to sign to receive. After all this, when you call or see online that both NOID/RFE is received by USCIS then you are safe to leave the country and travel. but still just in case be in touch with you lawyer and keep checking status online. NOID is nothing to fear about, its another form of RFE thats all. u will be fine

Thanks a lot. The strange thing is that, online it just shows same old message with very old date, no mention of RFE/NOID, I had called just because I saw changed LUD and thats when they said that they have sent NOID and RFE for spouse!
 
Call again and verify the info with at least another officer. Do not tell on your own that somebody had said that you are getting an NOID. Let them give you the info.
 
Yeah.. but we read here so many stories of getting the RFE/NOID in hand in time is the big deal. USCIS is known for crazy things like sending to some unknown attorneys office, your old address and also known to give some mistaken RFE and NOID updates. You should be around to sort all this out. Make sure you reply it in 30 days. So, put your vacation plans to next year. Sounds hard, but remember we are immigrants afterall. :--)

received the letters

Received NOID and RFE (for spouse), both are for TB skin test! The doctor had suggested to get X-Ray instead of skin test while submitting the initial forms (and it was also stated in the form to get either!). The interesting thing is that the letter says not to trust information on the form since it may be out of date! Hope they put it in the file on time.
