I-485 ..- need Ur advise

Hello,

You must have read so many msgs like this b4... but still posting for ur advise...

I've been working for a Coy since 97, never been on bench. I filed my 485 through that Coy on 15th of May'02. Due to some circumstances I quit the Coy and joined another Coy on 1st of May'03.

When I talked to the Lawyer (Coy's) he said.....

"he has been instructed by the Coy to send a letter to INS stating that Coy doesn't have the intent to hire me on a permanent basis and I don't have the intention of working for Coy on a permanent basis upon receiving my GC"

I'm sure he won't pay me one pay check too..!! Any advise is appreciated.

Why don't you take advantage of AC21 which allows change of employer after 180 days of applying I-485 ?

Since your company lawyer is going to send a letter like this, you might be better off infoming INS about your using AC21 by sending the new offer letter and A# (copy of I-485 receipt) to INS.
 
I would think...

that you should hire a new lawyer, and take his advice. Probably you should make use of AC21 and send a letter to INS immediately. I think you are perfectly within your rights according to AC21, as long as the job is similar to your first one.
 
Firstime, which lawyer sent this letter? Was it the guy from the old firm or new firm? If he is from the new firm then make sure that you send a whole package stating that you use AC21 and include all the relevant supporting info (offer letter with job description, salary,). The job offer letter can state that indefinite employement is based on approval of GC. Just don't have him send the employement letter without the other info relevant to AC21. If you search this forum, especially for last week, you can find a lot of info regarding AC21.

Were you one year out of a job? Or did you just made a typo with the year? Either way, as long as you have future job you should be fine.
