I-485 Lay off question - Guru\'s pl. help

My I-485 was filed on Feb2001. I have completed 180 days. I have applied
my EAD card on 6th July and waiting for approval. I am in situation of the lay off from my current employer. I have a couple of question.

1. If I am lay off from my current employer what is my status and what
should I do.
2. Whether my employer can withdraw my I-485 case at this stage.
 
Don\'t worry ! You are in status

No worries. Once you have filed I-485, you are in status and can remain in US till I-485 is adjudicated. Now that you have crossed 180 days, your employer can do nothing.

You can arrange to have H1 transfer through another known company if you still have H1 or you may continue with another company when you get your EAD.

This is the time you should have mental strength and keep saying to yourself that you will come out unscathed and ultimately get what you want

But one advice: Never burn bridges. Try to maintain relations with your employer. You never know when you need whom in this alien country.
 
You are fine...

Post 180 days you can freely work on EAD. For the same reason no one can cancel 485. Just make sure:

1. Get a job with a similar job description as in your labor cert.
2. Consult an attorney and ask about informing INS of the new job - this is not mandatory I have heard.
 
Be Cautious!

As ur h1 has expired and have no EAD ..U SHOULD NOT BE WORKING TILL U GET UR EAD IN HAND.

Ur status is adjustig status but cannot work as no EAD in hand...this may be tricky situation ..try to be with ur current comopany till u get ur EAD in hand ..avoid being on company payroll till u get ur EAD in hand

You should be fine. Obtain the Job title mentioned in the Labor certification. Ask the new employer to give you the offer letter with the same job title. Now you have one of 2 ways to choose

Notify INS about your Job Change using AC21. Provide them with the offer letter and change of your attorney (incase u change).

Note : INS may tranfer your case to your local INS.

or

Do the job switch and keep mum until INS sends you the RFE about the job change. Provide the info then and you should be okay. Keep all your paystubs from your old employer to prove that infact you were with the employer for 180 days after AOS.

I have seen posts with approvals using both ways. Talk to a qualified attorney to get his view.

Do not worry. You will be alright.

You would not worry about your green card and your status as fellow posters said in this thread. Find a job as soon as you can and work on EAD. You cannot work if you cahnge job while your EAD is pending, if you don\'t get approval before 90 days from your EAD notice date you can walk-in to local INS office and get EAD on the same day.

GoodLuck in finding new job incase if you get laidoff or you have to quit your present employer.
