Question:
Unfortunately I participated in unauthorized work for more than 180days. Looking back, I regret doing what I did because now I am applying for Employment Base Adjustment of Status to a permanent resident. My unauthorized work was many years ago, back in 1997. After my unauthorized work, I applied for H1B visa and was approved twice, the second time for an extension of the first H1B. During the period of the second H1B, I left the US in June 2005 and obtained a H1B visa stamp on my passport at a US Consulate in Vancouver, Canada. After my return to the US as a non-immigrant in H1B status, I filed I-485, Adjustment of Status a few weeks later. I have since received my EAD cards and have never once had any gaps, including during the period of my H1-B. I have not been out of status or worked without authorization since 1998 through my last entry into the US as a nonimmigrant in H1B status, and through my current status, and planning on keeping it this way.
Please advise on how working without authorization in 1997 is going to affect the outcome of my AOS. I searched online and found several information stating that the 180-days is counted from the last lawful admission prior to filing the I-485. I also read that traveling using Advance Parole while my case is pending may trigger a 3/10 year bar. I traveled using Advance Parole in December of 2006. Since my last entry into the US in 2005 which is prior to filing the I-485 as a non-immigrant status, I have not worked without authorization since 1998, am I okay?
Thank you so much for your time on this.
