I-485 Issues

RD I-485 04/03/2003.

EAD Renewal Applied 01/24/2004.Receiving Date : 01/28/2004

a. I have swithed the job a month ago. I have not send the AC 21 notification. I'm thinking of sending the employment verification letter w/ Salary with two pay checks. Can you please provide the Nebraska service center's address.

If above is correct, What po box should I need to put here?

b. My new employer states Sr. Business System Analyst ( Old as Sr. consultant). Is there any effect in this, if duties are same.

c. My current EAD is getting expired in May 29th 2004. I had applied for renewal while I'm with old employer. (If I don't receive the EAD renewal by that time)? Right now, I do not have the original I-485 notice (I do have xerox copy). Do I need to take the original when I goto BCIS office local

d. For RFE or anything does the BCIS will inform me or the attorney who had applied GC? How does it works? I do not have any attorney representing. Is it must to have an attorney?
The old attorney might ask for $1000.00 to support the rest.

e. I'm changing the home address on April 20th. How does this affects the GC processing?

- I know there are many opinions when it comes to this, but I am of the opinion that you should wait on sending anything until you get a RFE from NSC. At that point, you should send your AC21 letter and other supporting documents. My fear is that this could trigger transfer of your case to a local USCIS for interview and it may further delay your application.

- I read somewhere in this forum that the key phrase is "same or similar occupation" and your job title does not have to be exactly the same.

- You do not need the original I-485 receipt to file iEAD. A copy of the receipt would suffice.

- Did you file Form G-28 "Notice of Entry of Appearance as Attorney or Representative" along with your GC? If so, all your correspondence will go to the company attorney even if he is not representing you personally. You will get a courtesy copy of whatever USCIS sends to the attorney. Again, personally, I do not think that you need an attorney for EB I-485 unless you are being called for an interview.

e. I'm changing the home address on April 20th. How does this affects the GC processing?

- Not at all. However, just to be on the safe side, I would send Form AR-11 via Certified Mail and would definitely follow up with a phone call to USCIS to make sure your address has been updated.
