All,

My Labor has been approved and I am thinking of going for Concurrent Processing of I-140 and I-485. I am single now and hope to get married withing the next 3- 4 months. If I file my I-485 with I-140 now can I add my spouce at a later date to the I-485? If not, can I file the I-140 now and file I-485 at a later date, say after 3 months ( based on concurrent filing law) by showing my I-140 receipt notice?

Please advice

Thank You,

You can add your spouse anytime before your 485 is adjuducated. Given the current rate of processing your 485 would not be adjudicated in less than a year, so you should be fine if you get married in the next 6 months.

You could still file for your spouse under FB category if your 485 is approved, but that takes a long time.

Thats right ! I have done this myself. I filed for I-485 in Aug 2001 when i had no marriage plans in offing. Got married a year later (Aug 2002) and she joined me here on H4. We filed her I-485 in Oct 2002.

Well, inspite of being an RD 08/17/2001, i havent been approved yet. So i cant say if i am make a good role model for you.

Thank You,

Frodo and souzot1 for your advice.
Souzot1, has anyone else been approved for your RD, or did you get an RFE while your I-485 was being processed? Is your specific case being delayed or is it general for everyone for that RD?

Thanks
Suman
