I-485 interview at INS

Hi Folks,
Hope you can help me w/ the following questions wrt
adjustment of status interview at INS that we\'ll be
facing at the end of may \'02:

Our I-485 is employment-based but INS has asked for
an interview at the Newark, NJ office.

Q1. What do you think is this interview for ?

Q2. How important is it that our lawyer be present w/
us at the interview ?

Q3. Why has INS sent us medical forms w/ the interview
appointment letter ? We have already submitted them w/
our I-485 application one year back. Are we expected to
go through the medical exam again now ?

Q4. Any helpful tips for interview preparation and
conduct ?

  First of all, I wish all the best for the interview. Here are the answers for your questions:
  Q1. What do you think is this interview for ?
  This could be due to various reasons like reducing work load in INS center, clarifications on 485 application(s), change in company name, change in job, Finger prints not clear etc

  Q2. How important is it that our lawyer be present w/us at the interview ?
  If your 485 apllication is straight forward and did not change job then probably lawyer is not needed.

  Q3. Why has INS sent us medical forms w/ the interview
appointment letter ? We have already submitted them w/
our I-485 application one year back. Are we expected to
go through the medical exam again now ?
  It is always a good idea to redo medical even though your
medicals might be still valid.

  Q4. Any helpful tips for interview preparation and
conduct?
  Do not divulge any extra information. To the point and honest answers are always better. For the interview please take following things:
  1. Income Tax return for last 3 years
  2. Employment Letter
  3. Pay Stub for last 3 months
  4. Current Lease Agreement showing your name and your wife name
  5. Joint Bank Account statement
  6. All H1/H4 approval letters.
  7. Passport and Current I-94.
  8. EAD and AP, if applicable
  And, last but definately not the lease, dress in Business Formal.

I don\'t recommend on taking skin test xray vaccines again, but just
old record or a copy of old record should be fine.
 
What if after layoff no job at the interview

I could not bring all the stuff you mentioned above because I could not find a job after I was laid off 6 months ago.

Can the I-485 interview be delayed until I find a similar job?

Medical valid for a year

I think Medical is valid for a year only. So if its more than one year old you may have to do it again.
 
Medical Forms

The INS Medical is valid for one year. If your\'s was done less than one year ago, you\'re fine.

Chat User : Hi, Ms. Murthy. Can 245(k) save employee who filed I-485 in status and not having pay stubs at the time of RFE?

Attorney Murthy : If a person does not have pay stubs from the sponsoring employer but has them from another employer showing same or similar job, then that is all that is required. If there are no pay stubs then the concern of INS could be that the person will not work in the same or similar field. So they could hold the I-485 in abeyance until there is proof of a new job in the same or similar field. Really what is required is a future job offer, rather than being currently employed.
