I 485 Inquiry

Hi All,

It's been more than 3 months since I have started silently visiting this site, and never thought I would have anything to contribute. But now, I have a question, and I am hoping someone will be able to help.
My husband who never cared about the GC processing has got his approval last year while my case is still pending. His company is going through several layoffs now, and concerned, he has started looking for a new job. Now my question is: what happens to my 485 processing if he leaves the sponsoring company (since I am his dependent, his company applied for my 485 at the same time, RD June 2001).
My RFE was for birth certificate. I submitted an affidavit from my parents in Oct 2002. Unfortunately, there is a difference between the addresses in 485 application and affidavit. Affidavit has details of village, post office, new city name (Bharuch) while my passport and 485 only mentioned the name of the old city (Broach).
So, my case may go through some turbulences, and I thought it is better to stick with the same company. Company lawyer may be able to help in case some issues come up.
I would appreciate if anybody can provide some insight to my following questions. 1. what happens to my 485 if my husband leaves the sponsoring company? 2. Will the difference in birth place make any difference in my case?

When did you get the RFE for BC and when was the response sent?

My understanding is that you should not have any problems with your spouse changing jobs since he is already approved. Has your case been transferred to the local INS office

About the change in name of the birth city, you might be able to get a letter from the indian consulate stating that they are the same city incase you get further RFE.
 
No problem if your husband changes employers since his is already approved and you are just derivative or dependent. You should be fine. Whey they try to approve they will look at the primary applicant and since it is approved, they will adjudicate yours as well with no further employment questions.

Thanks for your response. I got the RFE in early October 2002. INS received my response on 31st Oct. I called IIO last week and my case is still with an officer.

God knows what's taking them so long. Hopefully they don't create any problem because of my birth place issue.
