I-485 Help.

New to this forum. Please help.

I had to travel (while on H1B) to India after filing for AOS and before receiving the I-485 receipts. Returned back on H1B and never had the I-485 receipts. This was a year ago and am well into 500 days after RD.

Is my application considered abandoned? Though I was told at that time it was not a problem.

Any inputs appreciated.

I did get the receipts after I returned back on H1. It's just that INS had not issued the receipts while I was travelling.

Is it true that since I did not have these while travelling on H1, it would be considered abandoned. Or am I being simply too paranoid and INS doesn't really care.

Are there any links that you could suggest that supports these?
 
take it easy

you got your receipts after you came back that in itself means that INS is processing your case. Another thing is have you done your finger printing thats another indication that your case is not assumed abandoned. Travelling on a vlaid H1 does not mean you have abandoned your app.
 
contact your lawyer, mine said you always need to show your original i-485 receipt along with your H-1 visa when you come back.

Yes. I did finish my fingerprinting way back in March of last year. I have found several links even from INS that H1/L1 guys can travel without having to worry abaout abandonment. But they don't go to explain in depth like having/noh-having to have the receipts while traveling.

I cannot contact my lawyer directly beacuse they go through my company. And probably will not be helpfull.

Added to this my company let my H1 expire (even though I wanted them to renew it) and am currently on EAD. Let's say the worst is that INS might consider it abandoned, can I get back onto my remaining H1 and reapply the 485.
