I 485 - For Parents who are in USA on a B2 visa

Hello -

My parents are visiting me in USA now and we are in the process of applying for their Green Card - separate application for each but will be mailed to USCIS together. As they are in USA we will be concurrently filing - I 130 and I 485 - separate set for each parent. Please suggest how to answer the below question on I 485 - for each application.

I 485 Part 5, 10: Is your current spouse applying with you?

I assume the answer will be - NO - either is not a derivative beneficiary on others application and they will have separate applications for each.

Please advise
 
Also I wanted some guidance on I 864 - Affidavit of Support. FYI - I am a one person household.

Considering I am submitting two separate affidavit of supports for each parent - is this how it should be filled for each?

As both the applications have separate set of forms the household size will be 2 instead of 3 in each. Is this logical?

Please advise.

Dear N - Any suggestions / thoughts on I-693? Should we submit it with the initial package - I-130, I-485, I-864 (and I-693) or do people generally wait to hear from USCIS (acceptance/rejection and/or a REF on application) to schedule and submit form I 693? The instructions for the form are not very specific on the timing - except for 60 day period.
 
Hello there. Hope you all are doing good.

As per the thread above - i applied for my parents in September 2019, Finger printing is done and we have received a RFE for I 485.

1. Birth Certificate for the Petitioner - which we had already submitted with the original application. Not sure why they asked again - but we will send it again with all the relevant secondary documentation as well.
2. Birth Certificate for the Beneficiaries - (as per snip below). We have submitted birth affidavits for both my parents with the application - as my parents are born 1941 and 1945. Both do not have Birth Certificates.

Both have Domicile Certificates, School Leaving Certificates - which states their place of birth - but does not state their parents name ( I guess in 1960's it was not a norm to have parents name in such documents). Also if we check the US Dept of State - Visa Reciprocity and Civil Document link shows that there were no Birth Certificates prior to 1970. As mentioned below - is this a sufficient enough evidence that there are no birth certificates available at the time of my parents birth?

Or

Should we try to get a NABC (Non Availability of Birth Certificate) document from a municipal authority in India. Also I have read about this being issued at the Indian Embassy in USA - but have heard / and read - that is not accepted if issued by a Indian Embassy.

If any of you have any suggestions or thoughts - it will be greatly appreciated.
