I am on OPT. Since dates are current, I am thinking to apply under EB2NIW category. My spouse is on F1.
I am planning to file simultanously I-140 and I-485. However, I do not want to apply for spouse's I-485 with my I-485. I would prefer to apply her I-485 later after my I-140 approval.
My question is: If my I-140 is approved in the future (say after 6 months), do I need to wait till dates become current to apply for my spouse's I-485? or can I apply even if dates are not current since she will apply on my I-140 approval??
How severe retrogression would be after 6-9 months?
