I-485 filing

Can a person file I-485,when his H1B expired and his H1B extenson ( filed before expiry ) is pending with INS. If he can , what to mention in current status and expires on columns of 1-485 application.My attorney is advising to wait for H1B Approval for filing I-485.

I would suggest to wait till you receive your H1B extension.

It doesn\'t make sense to apply before that, and could be detrimental to your application.
But ofcourse, lawyer would be more knowledgeable. Personally, I wouldn\'t apply before H1B extension is recieved.

Yeah, Should not apply with expired I-94. Chance of rejection is much more.

My I-94 expires on Jan31/2002, I have applied for my I485 On Dec 17th/2001 is it o.k?

My I-94 expires on Jan31/2002, I have applied for my I485 on Dec 17th , My employer applied for H1 extension, It has not yet come, is there any problem please reply
