Gurus,

Any helpful advice is welcome.

My PD is April 2004 and have I-140 pending with TSC. My wife's PD is Apr. 2007 and has her I-140 also pending. Now that the dates are current for 485 filing is it OK to file two applications for each of us. Meaning she filing as dependent on my application and me filing as dependent on her application. What are the pros and cons of doing so?

Secondly how are medicals handled in such a situation? can th civil surgeon give us two copies for each of us for submitting to different attorneys?

Anybody in same boat or has any experience with such a situation?

Please share.

Thanks

Hi,

I am also in the same boat, but the difference is mine and my wifes PD`s differ only by a month. I have consulted a lawyer and it seems that you cannot double apply I-485 meaning, you cannot be both primary and secondary applicant at the same time. You need to choose any one.

Good Luck,
Dampe

Why do you need 2 simultaneous applications? You can file I-485 using the April 2004 PD and include your family members as dependants.
