I-485 Filing issues

Hello,
My wife& daughter went to India on May23rd and return on Aug7th, my attorney says we cannot file their papers since they were'nt here when dates went current.

Can I file since we have time till Aug 17th??

Note- Our priority date is Dec-03 and I-140 is approved and my case for AOS has been filed in june and I have already received the receipt letter.
 
Your attorney is correct. If your dependants return in August, 2007 they will be coveredunder August Visa bulletin, which indicates no visa number available in any employment based category.
