I am currently working in the USA on a H1 visa. My employer has sponsored my green card application and now it is at a stage to file for I-485.
My wife is currently in India and possess B1/B2 visa.
My lawyer told me that she should be present in the USA physically when we file I-485.
Below are my questions:
1. When and how long will she need to be here?
2. Since she holds a B1/B2 visa, does this qualify her to travel or does she need another visa?
3. During pendency the disposal of the AOS, can she continue to travel on the B1/B2 visa or does she need to change?
We're exploring an option, that she travel here for the I-485 filing and return as soon as possible. In the interim of the disposal of the petition, she can plan to keep travelling up and down.
Is this possible?
