I-485 - employment-based as an alien of extraordinary ability-appl. April 27, 2006

Hi everybody!

I have filed my petition for I-485 adjustment of status on April 27th, 2006, along with I-131, I-140 and I-765. All the papers were received on May 3rd.

On May 18th, I took my first biometrics (never gave fingerprints before!) i. e. fingerprints and picutre taken.

The background check was mailed to the Nebraska service center on May 8, 2006, by my immigration attorney.

Does anyone know an estimated duration of I-485 approval in Nebraska service center. I live in Nebraska and study there at the univeristy.

There is also a minor issue. Although I have received my I-512L, I decided not to travel abroad, since I wanted an absolute, 100% clearance before I get my I-485 approved.

The minor issue is that I`ve been arrested in March 2004. The case was shoplifting, but the charges were eventually dropped in court since I had a good attorney.

Does anyone has any idea is this going to affect my status or not? I still continue my doctoral studies and I hope my case will get approved

Have you travelled abroad since March 2004? Were you questioned at the POE?
This might be an issue based on what the charges were and if you were convicted?
During citizenship, this might cause issues

I haven`t traveled abroad since my last entrance to the US on September 22, 2003. I believe it was a misdemeanor (shoplifting). My attorney did everything to drop my charges in April and May 2004. Between April 17 and May 17th, I did some community work, and on May 17th it was announced that the case was dismissed and the charges dropped.

During the actual arrest I WAS NOT FINGERPRINTED, THE STAFF JUST TOOK MY POLAROID PICTURE, WHICH , I BELIEVE, WAS TAKEN FOR THE STORE, NOT FOR THE POLICE RECORDS

MY I-485 HAS THE INTERNET RECORD from, I believe, www.123nc.com
which says that the case was dropped. However, I don`t have any papers or copies of this stuff in my own posession.

What can I do about it?

If you were not finger printed and no police were involved, then you should be OK.
Are you planning to leave the country any time soon? If so, please post your experiences at POE!
 
Look! The policeman WAS involved, but my fingerptints WERE NOT taken. the store just forced me to sign the papers where I agreed to pay them a fine (which I never paid).

Honestly, I am NOT planning to travel outside the US, although I haven`t seen my mom for three years, unless I get my I-140 and I-485 approval.
